Detailed terms & answers

We understand you might have questions about how our protection works. It's crucial to note that our Customer Performance Protection is not an insurance policy, nor is it a warranty. Instead, it's a unique contractual agreement that streamlines with existing MCS or FLEXI-ORB and EPVS or RECC practices, offering financial compensation for underperformance. Below, we've broken down the key aspects of our protection.

What is the purpose of the UK Renewable Performance Standard Protection?

This Performance Protection provides customers with financial compensation if their solar PV system underperforms against independently validated EPVS RECC projections, subject to the terms outlined. It is not a warranty, not an insurance policy, and does not replace manufacturer or installer warranties.

How does a system become eligible for Performance Protection?

To qualify for Performance Protection: The solar PV system must be installed by a UK Renewable Performance Standard-approved, MCS or FLEXI-ORB -accredited installer also be a member of EPVS or alike. The system must be installed in accordance with the validated system design and specifications. The customer must retain proof of system ownership and installation.

What is the Validated Performance Benchmark?

EPVS projections are independently validated by UK Renewable Performance Standard prior to installation. A 10% reduction (buffer) is applied to projected energy production (kWh) and savings. This reduced figure forms the protected performance benchmark.

When is a system deemed to have underperformed?

A system is deemed to have underperformed if the actual annual energy production is more than 10% below the validated and buffered EPVS projection, after accounting for reasonable environmental variation.

What are the compensation terms for underperformance?

If underperformance is confirmed: Compensation is payable every 24 months as this provides a more realistic performance, considering annual seasons can differ year by year into account. Compensation is capped at £200 per calendar year. The maximum total compensation payable over the life of the protection is £2,000. Protection is valid for up to 10 years from system commissioning date.

What exclusions apply to the protection?

Compensation will not be payable where underperformance results from: Changes in property use or electricity consumption patterns; Shading caused after installation (e.g. new buildings, trees, extensions); Grid outages or export limitations; Equipment tampering, modification, or poor maintenance; Inverter failure not repaired within a reasonable time; Damage caused by extreme weather, fire, flooding, or force majeure; Failure to provide accurate generation data.

What are the customer's obligations under this protection?

The customer agrees to: Operate the system in accordance with manufacturer and installer guidance; Maintain the system in reasonable working condition; Allow access to generation data (smart meter, inverter monitoring, or equivalent); Notify the installer or UK Renewable Performance Standard (if your installer has seized to trade) of faults promptly. Failure to meet these obligations may invalidate the protection.

How does the claims process work?

Claims must be submitted within 60 days of the end of each 24 months. UK Renewable Performance Standard will review generation data and confirm eligibility. Approved claims will be paid within 5 days of validation.

Is the Performance Protection transferable?

This Performance Protection is not transferable unless expressly approved in writing by UK Renewable Performance Standard. Property sale or system relocation may invalidate the protection.

What are the limitations of liability for UK Renewable Performance Standard?

UK Renewable Performance Standard’s total liability to the customer is strictly limited to the compensation caps outlined in Section 5 (Compensation Terms). The Company shall not be liable for indirect, incidental, or consequential losses, including loss of earnings or increased energy costs.

What is the relationship between UK Renewable Performance Standard and the installer?

The installer remains solely responsible for system installation, workmanship, and compliance. UK Renewable Performance Standard is not responsible for installation defects, delays, or installer performance.

Under what circumstances can the protection be terminated?

UK Renewable Performance Standard reserves the right to terminate protection where: Fraud or misrepresentation is identified; Installer accreditation is withdrawn due to non-compliance; System data is falsified or withheld. No compensation shall be payable following termination.

What law governs these Terms & Conditions?

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.

How is acceptance of these Terms & Conditions confirmed?

Receipt of a Certified Solar Performance Protection Certificate constitutes acceptance of these Terms & Conditions.

When does the protection become active for the customer?

The protection is included in the solar system purchase price for the customer at the point of sale. The installer must have membership with UK Renewable Performance Standard before they can offer our service.

What makes this protection unique compared to other options?

The fact that it compensates money up to £200 a year for 10 years if the system underperforms against a realistic buffer, directly providing financial peace of mind, sets our offering apart. It's a proactive safeguard, not just a reactive fix.
